West Virginia Veteran Benefits: What the Statutes Actually Say
West Virginia's veteran benefits, cited to code. Military retirement is fully deductible, and the property tax benefit is a refundable income tax credit you have to claim.
West Virginia is quietly one of the best states in the country for a disabled military retiree, and the reason is almost hidden: its property tax benefit is not an exemption at all. It is a refundable credit on your state income tax return that gives you back the full property tax you paid on your home.
That design has a consequence nobody warns you about. You have to pay the property tax first, on time, and then claim it back. Miss either step and you get nothing.
Every figure below is cited to the code section or state agency that administers it.
Military retirement pay: fully deductible, no cap
Under W. Va. Code 11-21-12, all military and uniformed-services retirement income is fully deductible from West Virginia income, with no dollar cap, for tax years after 2017. The earlier $20,000 cap was removed.
Survivor annuities are included. That is explicit in the code and is often left out of state comparisons.
West Virginia's top marginal rate is 4.82 percent, so the deduction is worth less per dollar than Vermont's or Hawaii's, but it applies to everything with no income test and no age test. VA disability compensation is not taxable at either level.
Property tax: a refundable credit, not an exemption
Here is the mechanism, and it is worth understanding precisely.
Under W. Va. Code 11-13MM-4, effective for tax years beginning on or after 1 January 2024, an eligible veteran receives a refundable state income tax credit equal to the full West Virginia real property tax paid on their homestead.
Eligibility:
- A combined service-connected disability rating of 90 to 100 percent
- Owner-occupied homestead used exclusively for residential purposes
- The property tax must be timely paid
- The credit is claimed on your West Virginia income tax return
Because the credit is refundable, you get the money even if your state income tax liability is zero, which it often will be for a retiree whose military pension is fully deducted. So in practice this works out to a full exemption of your property tax.
Three practical consequences:
- The threshold is 90 percent, not 100. A veteran at 90 percent gets the same benefit as one at 100. That is more generous than most states and it is routinely misreported as a 100-percent-only benefit.
- You must file a state return to get it, even with no taxable income. A military retiree who assumes they need not file because everything is deducted will simply never receive the credit.
- Cash flow matters. You pay the county, then recover it at tax time. Budget for the gap.
West Virginia's effective property tax rate is about 0.51 percent, among the lowest in the nation, so the underlying bill is modest to begin with. West Virginia is one of the 22 jurisdictions that effectively fully exempt property tax at 100 percent permanent and total. This site previously omitted it from that list in error, corrected 5 November 2026.
There is also a separate, older benefit. Under W. Va. Code 11-6B, a $20,000 assessed-value homestead exemption exists for veterans rated 100 percent permanent and total. That is a different mechanism from the 11-13MM credit and is administered by your county assessor rather than through your tax return.
State employment preference
Per the West Virginia Division of Personnel:
- 5 points added to a passing state civil-service exam score for honorably discharged veterans
- An additional 5 points for disabled veterans and Purple Heart recipients, to a maximum of 10
Hunting, fishing and trapping
Resident veterans qualify for free Class Q hunting and fishing and Class QQ trapping licenses if they have:

Tax breaks, education benefits, and hiring preferences across all 50 states.
- A 100 percent permanent and total service-connected VA rating, or
- A VA specially adapted vehicle grant, or
- Former POW status
See WV Division of Natural Resources.
Note the threshold here is 100 percent, stricter than the 90 percent used for the property tax credit. The two benefits do not share a qualification line, which catches people out.
Vehicles and plates
Disabled Veteran plate with registration fee exemption. Veterans with a 100 percent permanent and total service-connected disability, or a VA specially adapted vehicle grant, receive a Disabled Veteran plate with no registration fee on one vehicle. Small insurance and litter fees still apply.
The application must be certified by the West Virginia Department of Veterans Assistance, not just submitted to the DMV, which adds a step people miss. See WV DMV.
The state veterans facilities
West Virginia runs two, with different levels of care, per WV Department of Veterans Assistance:
- WV Veterans Nursing Facility, Clarksburg. A 120-bed skilled nursing facility.
- WV Veterans Home, Barboursville. Independent and assisted living.
Eligibility: honorably discharged veterans who served 12 months, are VA-eligible, and pass a pre-admission physical. Surviving spouses may also apply.
Having both a skilled nursing facility and an assisted living home means you are less likely to have to leave the state system as care needs increase.
Education for surviving family
The War Orphan Education Program provides children aged 16 to 25 of West Virginia service members who died as a result of wartime military service with tuition and fee waivers, plus a capped room, board and books stipend, at West Virginia public postsecondary institutions. See WV Department of Veterans Assistance.
What the common summaries get wrong
| Claim you will see | What is actually true |
|---|---|
| "West Virginia caps the military retirement deduction at $20,000" | Out of date. Cap removed for tax years after 2017. Fully deductible, no cap. |
| "Survivor annuities are taxed" | No. Included in the deduction. |
| "You need 100% for the property tax benefit" | No. A combined rating of 90 to 100 percent qualifies. |
| "It is a property tax exemption" | No. A refundable credit claimed on your state income tax return. |
| "It applies automatically once you are rated" | No. You must pay the tax on time and file a state return to claim it. |
| "No need to file a state return if your pension is deducted" | File anyway, or you forfeit the credit. |
| "Free hunting licenses at 90%" | No. 100% P&T, adapted vehicle grant, or POW status. |
If you are considering West Virginia
On paper this is one of the strongest combinations available: a full military retirement deduction with no cap or age test, a 0.51 percent effective property tax rate, and a refundable credit that returns the property tax you paid at a 90 percent rating rather than 100.
The entire value depends on actually claiming it. Pay the county on time, file the West Virginia return even with no taxable income, and get the Department of Veterans Assistance certification for the plate. Three administrative steps, and each one is a place where the benefit quietly fails to arrive.
