New Mexico Veteran Benefits: What the Statutes Actually Say
New Mexico's veteran benefits, cited to statute. As of 2026 the disabled veteran property tax exemption prorates by rating, which is rare and worth understanding.
New Mexico did something in 2026 that almost no other state has done: it made the disabled veteran property tax exemption proportional to your rating. A veteran at 60 percent now gets 60 percent of their primary residence exempted. Everywhere else, you either clear a threshold or you get nothing.
That change, plus a full waiver at 100 percent permanent and total, makes New Mexico one of the stronger property tax states for disabled veterans. The income tax side is more limited than people expect.
Every figure below is cited to the statute or the state agency that administers it.
Military retirement pay: $30,000 exempt, not all of it
New Mexico taxes income with a top marginal rate of 5.9 percent, and exempts up to $30,000 of military retirement pay for tax years 2024 through 2026. See NMSA 7-2-5.13.
Worth knowing: a 2026 bill, HB 221, would have made military retirement 100 percent exempt. It died in committee, so the $30,000 cap still applies for 2026. If you are reading this later, check whether a successor bill passed, because this one has been attempted more than once.
Retirement pay above $30,000 is taxed as ordinary New Mexico income. VA disability compensation is not taxable at either level.
Property tax: the proportional exemption is the headline
Three separate things here, and they stack differently depending on your rating.
1. Standard veteran exemption: $10,000 of taxable value. Any honorably discharged veteran who is a New Mexico resident may exempt up to $10,000 of the taxable value of their property. A November 2024 constitutional amendment raised this from $4,000, with future increases pegged to inflation. Confirmed on the New Mexico Department of Veterans Services benefits page.
2. Full waiver at 100 percent permanent and total. Under NMSA 7-37-5.1, a resident honorably discharged veteran rated 100 percent permanent and total receives a full waiver of property tax on the primary residence, covering up to 5 acres.
3. Proportional exemption below 100 percent, effective tax year 2026. This is the new part, from the HB 47 / 2024 constitutional amendment. The exemption now equals your disability rating percentage applied to the taxable value of your primary residence. A 90 percent rating exempts 90 percent of taxable value. A 30 percent rating exempts 30 percent.
New Mexico's effective property tax rate is about 0.63 percent, which is already low. Combine a low rate with a proportional exemption and the outcome for a mid-rated veteran is better than in most states, where a 40 or 60 percent rating produces nothing at all.
New Mexico is one of the 22 jurisdictions that do fully exempt property tax at 100 percent permanent and total.
You must file. The exemption is not automatic. You file your certificate of eligibility with your county assessor, and the exemption applies from then on. The state reported roughly 7,000 partially disabled veterans taking up the new proportional exemption in its first few months, which means plenty of eligible people still have not filed.
Surviving spouses
An unremarried surviving spouse of an eligible honorably discharged veteran may claim the standard veteran exemption, now $10,000 of taxable value. The full property tax waiver for a veteran rated 100 percent permanently and totally disabled also passes to the unremarried surviving spouse. See NM DVS.
State employment preference
Per the New Mexico State Personnel Office:
- 5 points added to the final passing score on state screening exams, for honorably discharged veterans and current National Guard members
- 10 points for veterans with a VA service-connected disability
State parks: free lifetime pass for every resident veteran

Tax breaks, education benefits, and hiring preferences across all 50 states.
This is one of the most generous recreation benefits in the country and it is routinely missed.
Since 1 July 2025, under HB 161, any New Mexico resident veteran can obtain a free lifetime pass, issued as a rearview-mirror hang tag, giving free day use and camping at all New Mexico State Parks. See EMNRD State Parks Division.
No disability rating required. Camping included, not just day use. For a state with 35 state parks, that is a substantial recurring benefit for any veteran who spends time outdoors.
Hunting and fishing
Free lifetime card at 100 percent. New Mexico resident veterans rated 100 percent service-connected disabled receive a free lifetime fishing, small game hunting and deer hunting card.
$10 license below 100 percent. Veterans rated below 100 percent may buy a game hunting and fishing license for $10. See NM Department of Game and Fish.
Vehicles and licenses
Disabled Veteran plate, free, at 50 percent or above. Veterans with proof of a 50 percent or greater service-connected disability may register up to two vehicles, including motorcycles, with a Disabled Veteran plate at no fee, and with no registration fee. Apply by mail to the MVD Vehicle Services Bureau in Santa Fe. See NM MVD military and veteran plates.
Two vehicles rather than one is unusual and worth claiming if you qualify.
Veteran designation on a driver license or ID, through the Motor Vehicle Division with proof of honorable service. See NM MVD.
The state veterans home
The New Mexico State Veterans Home in Truth or Consequences is open to honorably discharged veterans and their spouses.
The notable eligibility point: New Mexico residency is not required. Residents receive admission preference, but an out-of-state veteran may apply. Fees apply. Few state veterans homes are open to non-residents at all, so this is worth knowing if you have family in the area.
What the common summaries get wrong
| Claim you will see | What is actually true |
|---|---|
| "New Mexico fully exempts military retirement" | No. Up to $30,000 for tax years 2024-2026. HB 221, which would have made it 100%, died in committee. |

| "Only 100% disabled veterans get a property tax exemption" | Not since tax year 2026. The exemption now prorates by rating, from 10% to 100%. |
| "The exemption is automatic once you are rated" | No. File your certificate with your county assessor. |
| "The state parks pass requires a disability rating" | No. Free lifetime pass for any resident veteran since 1 July 2025, camping included. |
| "The DV plate covers one vehicle" | Two, at 50% or above. |
| "You must be a New Mexico resident for the veterans home" | No. Residency gives preference, not eligibility. |
If you are considering New Mexico
New Mexico is a genuinely good property tax state for disabled veterans at any rating, which is rarer than it sounds. The proportional exemption means a 40 or 50 percent rated veteran gets something real here and nothing in most of the country, and the full waiver at 100 percent P&T sits on top of an already low 0.63 percent effective rate.
The weaker side is income tax: $30,000 of military retirement is exempt and the balance is taxed at up to 5.9 percent. If your pension is well above $30,000, model that against a no-income-tax state before deciding.
